GENERAL TERMS AND CONDITIONS OF SALE – MOTO MAROC SPIRIT
1. Purpose
These General Terms and Conditions of Sale define the terms and conditions for booking, participation and cancellation of motorcycle tours organized by South Morocco Travel, RC 7473/1082, 465 Dar Al Aman City, Al Houda, 80000 Agadir — hereinafter referred to as “the Organizer.”
2. Registration & Booking
Registration is considered final only upon receipt of:
-
a fully completed registration form,
-
payment of a 30% deposit of the total price (including taxes) by bank transfer,
-
a copy of a valid passport,
-
a copy of a valid motorcycle driving licence (Category A),
-
mandatory supporting documents:
-
repatriation insurance and medical expenses abroad,
-
third-party liability insurance covering motorcycle riding.
-
The balance must be paid no later than 30 days before departure.
For bookings made less than 30 days before departure, full payment is required at the time of registration.
3. Prices
Prices are expressed in euros or Moroccan dirhams, depending on the case.
The price includes:
-
motorcycle rental according to the chosen package,
-
accommodation according to the chosen package,
-
half-board (dinner + breakfast), except for nights in Agadir,
-
logistical support and a guide driving the support 4x4 vehicle,
-
round-trip airport transfers,
-
full supervision and organization of the trip.
The price does not include:
-
international flights,
-
lunch meals,
-
drinks and personal expenses,
-
mandatory insurance (repatriation, motorcycle third-party liability, cancellation),
-
tips, hammam, massages and personal purchases.
Prices may be adjusted in the event of significant cost variations (fuel, exchange rates, taxes, etc.).
4. Program Modifications
To ensure group safety, the Organizer may modify the itinerary, stage duration or accommodation depending on:
-
weather conditions,
-
track and road conditions,
-
logistical constraints,
-
safety requirements.
Such changes, when due to external circumstances, do not entitle participants to any refund.
5. Cancellation
a) Cancellation by the participant
Any cancellation must be submitted in writing (email or letter).
The following cancellation fees apply:
-
More than 60 days before departure: full refund of the deposit
-
Between 60 and 30 days: 30% of the total amount retained
-
Between 30 and 15 days: 50% of the total amount retained
-
Less than 15 days: 100% of the total amount retained
b) Cancellation by the Organizer
A tour may be cancelled if exceptional circumstances compromise group safety.
In this case, all amounts paid will be fully refunded, with no additional compensation.
6. Mandatory Insurance
Each participant must hold:
-
repatriation and medical expenses insurance abroad,
-
motorcycle third-party liability insurance,
-
cancellation insurance (recommended).
The Organizer declines all responsibility in the event of:
-
theft,
-
accident,
-
loss of personal belongings,
-
damage to the participant’s personal equipment.
7. Motorcycle Insurance (included with rental)
At Moto Maroc Spirit, all motorcycles are covered by a comprehensive insurance package:
✔ Third-Party Liability: damage caused to third parties
✔ Comprehensive Insurance: falls, accidents, theft, fire
➡ Deductible: €2,500 in case of partial or total rider responsibility
✔ 7/7 Assistance on road and tracks: breakdown service, towing, motorcycle recovery
8. Conditions of Participation
Participants must:
-
be at least 18 years old,
-
hold a valid Category A motorcycle licence,
-
be physically fit to ride in off-road conditions,
-
wear full protective motorcycle gear:
-
approved helmet,
-
gloves,
-
boots,
-
reinforced jacket and trousers,
-
-
comply with:
-
Moroccan traffic laws,
-
guide instructions,
-
environmental protection rules.
-
9. Liability
The Organizer cannot be held responsible for:
-
reckless or dangerous behavior by a participant,
-
delays or changes caused by external factors (weather, mechanical failures, customs, etc.),
-
material or bodily damage caused by the participant.
10. Motorcycle & Equipment
The participant is responsible for damage:
-
caused by improper use,
-
or resulting from use not covered by insurance.
11. Claims & Disputes
Any claim must be submitted within 7 days after the end of the trip.
An amicable solution will be sought in priority.
Failing this, the courts of Agadir shall have exclusive jurisdiction.
